First DUI Offense? You May Qualify To Keep It Off Your Record
The consequences of a DUI conviction in Massachusetts are severe. First-time offenders, however, are sometimes shown leniency in the form of alternative sentencing that leads to dismissal of charges, especially if the chances of a repeat offense appear low.
These alternatives for first-time DUI are not automatic. Francis M. Doran, Jr., is a former prosecutor who now represents DUI defendants. His experience with the court system provides an immense advantage to his clients. He understands the prosecutor’s methods and the policies behind sentencing decisions, allowing him to seek advantageous plea agreements in many cases. He is well-versed in the second chance program available to qualifying first offenders.

Alternative Sentencing For A First Offense Of DUI/OUI
Our law firm represents people charged with DUI/DWI/OWI. The normal consequences of conviction for a first-offense DUI include:
- Fines up to $5,000
- One-year license suspension, with the possibility to obtain a hardship license after three months
- Up to 2 1/2 years in jail
- Increased insurance costs for at least a year
For those arrested for first-offense DUI, Mr. Doran will seek alternative sentencing in lieu of conviction to avoid a criminal record. This “alternative disposition” probation plea bargain, called the 24D Program, requires that you participate in court-ordered drug and alcohol education. You will still lose your license for 30 days (or 210 days if you have been charged with underage DUI). If you complete all terms of probation, the DUI conviction will be dismissed.
Convictions for repeat DUI offenses are much more severe. If previously convicted of a DUI, even years earlier or in another state, the alternative disposition program for first-offense DUIs is not available to you. For this reason among many others, it is very important that you work with an experienced DUI attorney to avoid conviction.
