Massachusetts General Laws, Chapter 266, Section 30 codifies the crime of larceny in Massachusetts. The law extends to all forms of common law larceny, including embezzlement and larceny by false pretenses. Larceny of property of a value in excess of $250 is a felony punishable by up to five years in the state prison.

What Are The Penalties For Larceny?

Despite the severity of the allegation, these cases are often prosecuted in the district court where the penalty cannot exceed 30 months in the house of correction. The prosecution must prove three things beyond a reasonable doubt to convict you of larceny:

  1. You took and carried away property
  2. That the property was owned or possessed by someone other than the accused
  3. That you intended to deprive the person of the property permanently
