Complying With And Challenging Sexual Offender Registration

Massachusetts requires that all those convicted of sex crimes register with the Sex Offender Registry Board. This is the state agency responsible for keeping a database of convicted sex offenders and classifying each offender’s status. The level of classification will make a big difference in terms of your everyday personal freedoms.

Sexual Offender Classification Levels

  • Level 1:  The Sex Offender Registration Board (SORB) determines that the person is at low risk to re-offend and poses minimal danger to the public. Level 1 offenders must register with local law enforcement and their information is shared with other government agencies, but their status is not made available to the public.
  • Level 2: The SORB determines the person is at moderate risk to re-offend and that the degree of danger to the public warrants making their sex offender status publicly available. The public will have access to Level 2 offender information through the local law enforcement agency, which will determine which parties (if any) should be notified of the offender’s status.
  • Level 3: The board determines that the person is at high risk to re-offend and poses substantial danger to the community. Law enforcement agencies may actively disseminate information about the Level 3 offender, and the public will have access to the information about their sex offender status through the local police department and through the SORB. Active dissemination of information means your photo will be posted in the post office, schools, on the Internet and in public places around the neighborhood.

Once you are classified, it is an uphill battle to get off the sex offender registry or reduce one’s classification level. That is why it is so important to hire an attorney early in the process, to argue that you pose no danger to the community and to fight a sex crime conviction.
